The grandparent or grandparents of a minor child may have a right to petition the Court for custody rights by demonstrating, to the satisfaction of the Court, the existence of a meaningful relationship with the children, or standing. Without the existence of a prior relationship, the Court may not reach the issue of what are the best interests of the child.
The grandparent or grandparents of a minor child also have the right to petition the Court for visitation rights after the death of either or both parents of a minor child, or under the circumstances where it would seem fit for the grandparent or grandparents to intervene. Once the issue of standing has been established, the Court may issue an Order of visitation for grandparents, separate and apart from other Orders for visitation that may exist between the parents of the child.
